Two newspapers, six weeks

A notice of formation runs once a week for six successive weeks in two newspapers designated by the Chautauqua County clerk.

120-day deadline

The clock runs from the day your articles of organization become effective — publication must be completed within 120 days.

Certificate of Publication

After the runs finish, the newspaper affidavits are filed with the NY Department of State with its $50 filing fee.

If the deadline is missed

The LLC's authority to conduct business is suspended until the certificate is filed — fixable, but not a place to stay.

Requirements above are from Section 206 of the NY LLC Law, per the NY Department of State. Newspaper rates are set by the papers themselves and vary by county — your quote shows the exact all-in number before anything runs.

How we handle it

  • We set up the runs

The notice is prepared correctly and placed with newspapers designated for Chautauqua County — you don't contact anyone.

  • We collect the affidavits

Each paper signs an affidavit of publication when its six weeks finish. We chase and collect both.

  • We file the certificate

Certificate of Publication filed with the Department of State, and your stamped proof delivered.

Chautauqua County publication questions

When does my 120 days start?

From the effective date of your articles of organization — usually the day New York accepted your LLC filing. If you tell us your formation date, we work the schedule backward so the runs finish in time.

What if my LLC already missed the deadline?

It's fixable. The state suspends the LLC's authority to do business until the certificate is filed — once we complete publication and file it, the suspension is annulled. The sooner it starts, the sooner it's cured.

Why do publication costs vary so much?

The newspapers set their own rates, and each county clerk designates different papers. That is why we quote your county exactly — one flat number with the newspapers and the $50 state filing included — instead of advertising a teaser price.
